Terms of Service

These Terms of Service (“Terms”) govern your use of the Image Tools Kit website and all associated tools, features, and services made available through the website (collectively, the “Service”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

Acceptance of terms

By visiting the Image Tools Kit website, interacting with any of its tools, or otherwise making use of the Service in any manner, you confirm that you are at least eighteen (18) years of age and that you accept these Terms in their entirety. Your continued use of the Service following any changes to these Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically. The “last updated” date at the top of this page indicates when these Terms were most recently revised. If any updated version of these Terms is unacceptable to you, you must cease all use of the Service immediately.

If you are using the Service on behalf of an organization, entity, or group, you represent and warrant that you have the authority to bind that organization to these Terms, and the terms “you” and “your” will refer to that organization. If you do not have such authority, you must not accept these Terms and must not use the Service.

Description of the service

Image Tools Kit is a free, privacy-first suite of online image tools. The current catalogue of tools includes, but is not limited to, image compression, format conversion, resizing, cropping, metadata removal, color analysis, image comparison, and accessibility checks. The Service is provided entirely free of charge, with no subscription tiers, no premium upsells, and no requirement to create an account.

The Service is designed so that the overwhelming majority of tools operate entirely within your web browser. A small number of specialized tools are clearly and individually labeled as “temporary upload” tools; these require a file to be transmitted to a temporary server-side endpoint in order to complete the requested operation. Every tool, regardless of whether it is client-side or server-assisted, is described in detail in the section titled “Local processing and temporary uploads” below.

The Service is provided on an as-is basis. The Image Tools Kit operator does not guarantee the availability, uptime, speed, or continued existence of any particular tool, feature, or the website itself. The operator reserves the right to modify, suspend, or discontinue any part of the Service at any time without prior notice, and without liability to you.

Eligibility

The Service is intended for use by individuals who are at least eighteen (18) years of age, or the age of majority in their jurisdiction, whichever is greater. By using the Service, you represent and warrant that you meet this age requirement. The Service is not directed to children under the age of thirteen (13), and the operator does not knowingly collect personal information from children. If you become aware that a child has used the Service, please contact the operator at imagetoolskit@gmail.com so that appropriate steps can be taken.

The Service is available to users worldwide, subject to applicable local laws. You are solely responsible for ensuring that your use of the Service complies with all laws, regulations, and rules applicable to you in your jurisdiction, including any restrictions on the types of content you may process or upload.

Free use and no account requirement

The Service is entirely free. There are no hidden fees, no subscription plans, and no paywalls. You may use the Service as many times as you wish without cost. No account creation, registration, login, email address, or any form of personally identifiable information is required to access or use any tool on the Service.

The operator reserves the right to introduce account-based features in the future, but any such features would be entirely optional. The core functionality of the Service will remain available without an account. If account-based features are introduced, these Terms will be updated to reflect any additional obligations or data practices associated with them.

Ownership of your content

You retain full and complete ownership of every image, file, or other content (“Your Content”) that you upload to, process through, or otherwise submit to the Service. Nothing in these Terms transfers ownership of Your Content to the Image Tools Kit operator, and the operator expressly disclaims any claim of ownership over Your Content.

You grant no license, whether express or implied, to the operator with respect to Your Content. The operator does not acquire any rights in Your Content as a result of your use of the Service. You may freely use, distribute, sell, license, or otherwise exploit Your Content without any obligation to the operator.

This ownership model is a core principle of the Service. The operator’s business model, such as it is for a free tool, does not depend on user content. The operator does not analyze Your Content for advertising purposes, does not sell or share Your Content with third parties, and does not use Your Content to train machine learning models or for any other purpose beyond delivering the specific operation you requested.

Your responsibilities and acceptable use

While the operator does not monitor, review, or screen Your Content, you are solely responsible for the content you upload to and process through the Service. By using the Service, you represent and warrant that:

  • You own or have obtained all necessary rights, licenses, consents, and permissions to use and to authorize the Service to process Your Content.
  • Your Content does not and will not violate any applicable law, regulation, or right of any third party, including but not limited to copyright, trademark, trade secret, right of publicity, right of privacy, moral rights, or any other intellectual property or proprietary right.
  • Your Content does not contain any material that is unlawful, defamatory, obscene, pornographic, abusive, harassing, threatening, hateful, or otherwise objectionable.
  • You will not use the Service to process content that depicts or promotes child sexual abuse material in any form, and you acknowledge that the operator will report any such material to the appropriate authorities.
  • You will not use the Service to process content for the purpose of creating, distributing, or deploying malware, phishing campaigns, spam, or any other harmful or deceptive materials.
  • You will not attempt to interfere with, disrupt, or compromise the integrity, security, or performance of the Service or any related infrastructure.

These obligations survive any termination or suspension of your access to the Service. The operator reserves the right to cooperate fully with any law enforcement authority or court order requesting or directing the disclosure of the identity of anyone believed to have used the Service in violation of any applicable law.

Local processing and temporary uploads

Client-side processing

The majority of the tools offered by the Service operate entirely within your web browser using the HTML5 Canvas API, the File API, and related browser technologies. When you use a client-side tool, your image never leaves your device. No file data is transmitted to any server. The processing happens locally in your browser, and the processed result is returned directly to you. The operator has no access to, and retains no copy of, any image processed in this manner.

Client-side processing means that the quality, speed, and format support of the output depends on your browser, operating system, device hardware, and browser configuration. The operator does not and cannot guarantee that any particular output format or quality level will be available on your specific setup. It is your responsibility to verify that the output meets your needs before discarding the original file.

Temporary uploads

A small number of tools require a file to be uploaded to a temporary server-side endpoint in order to complete an operation that cannot be performed in the browser alone. These tools are clearly and individually labeled “temporary upload” so that you can make an informed decision before using them. When you use a temporary upload tool, the following protections apply:

  • Your file is assigned a random, non-sequential filename on the server. The original filename is discarded immediately and is never stored, logged, or used.
  • Files are hard-capped at 25 megabytes (25 MB). Any file exceeding this limit will be rejected before it is fully uploaded.
  • Every uploaded file is validated using MIME type detection based on magic bytes, not file extensions. Files that do not match a supported image MIME type are rejected and deleted immediately.
  • Your file is processed and the result is returned to your browser. The uploaded file is never served back to the public internet and cannot be accessed by other users of the Service.
  • The uploaded file is programmatically and permanently deleted from the server immediately after processing is complete. “Immediately” means within seconds of the processing operation finishing.
  • The operator does not retain, archive, cache, index, analyze, or monetize any uploaded file. Once processing is complete and the file is deleted, no copy of the file exists on the operator’s systems.

No retention warranty

While the operator has designed the temporary upload system to delete files as quickly as possible after processing, the operator cannot provide an absolute guarantee that a residual copy of a file does not exist for a brief period in system memory, temporary caches, or disk buffers that are beyond the operator’s direct control. You should not upload files to the temporary upload tools that you consider extremely sensitive or that you would not want to exist in any form on any server. For the highest level of privacy, prefer the client-side tools whenever they meet your needs.

Prohibited uses

In addition to the acceptable use requirements described above, you agree not to use the Service for any of the following purposes:

  • Illegal activity: Using the Service to process images that are evidence of, or are intended to facilitate, any illegal activity under applicable law.
  • Copyright infringement: Uploading images you do not own or do not have the legal right to modify, and distributing the resulting output as your own work or the work of another.
  • Trademark violation: Using the Service to create or modify images in a manner that constitutes trademark infringement, counterfeiting, or unfair competition.
  • Impersonation and fraud: Using the Service to create, alter, or enhance images for the purpose of deceiving, defrauding, or impersonating any individual, entity, or brand.
  • Deepfakes and non-consensual content: Using the Service to create, modify, or distribute deepfake images, synthetic depictions of real individuals without their consent, or non-consensual intimate imagery.
  • Surveillance and facial recognition: Using the Service to process images for the purpose of building or feeding surveillance systems, facial recognition databases, or biometric identification systems.
  • Automated access: Accessing the Service through automated scripts, bots, crawlers, scrapers, or any other automated means without the express written permission of the operator. The operator may deploy technical measures to detect and block automated access.
  • Reverse engineering: Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or underlying technology of any part of the Service.
  • Rate abuse: Submitting an excessive or unreasonable number of requests in a short period of time in a manner that degrades the performance or availability of the Service for other users.
  • Security testing: Attempting to probe, scan, or test the vulnerability of the Service or any related system or network without the express written authorization of the operator.
  • Interference: Introducing viruses, worms, Trojan horses, logic bombs, or other material that is malicious or technologically harmful; attempting to gain unauthorized access to any part of the Service, its servers, or any connected database or system.
  • Circumvention: Attempting to circumvent any technical limitation, usage restriction, rate limit, or access control applied to the Service.
  • Redistribution: Systematically downloading, mirroring, caching, or redistributing the Service or any substantial portion thereof for the purpose of creating a competing product or service.
  • Data harvesting: Using the Service to collect, aggregate, or harvest data about other users, their behavior, or their content.
  • Hate and harassment: Using the Service to process content that promotes hatred, discrimination, violence, or harassment against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.

The operator reserves the right, but has no obligation, to investigate and take appropriate action against anyone who, in the operator’s sole discretion, violates this section. Such action may include removing offending content, suspending or terminating access to the Service, and reporting the matter to law enforcement authorities.

Intellectual property

The Service itself, including but not limited to its website design, source code, text, graphics, logos, icons, user interface, tool functionality, and all other original content created by the operator, is the property of the Image Tools Kit operator and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its source code without the express written permission of the operator.

The operator does not claim, assert, or imply any ownership interest in Your Content. Your images, files, and processed outputs are yours. The operator’s intellectual property rights are limited to the Service’s own code, design, and original content. No license is granted to you in the operator’s intellectual property by virtue of your use of the Service, and no license is granted to the operator in Your Content by virtue of your use of the Service.

If you believe that any content on the Service infringes your intellectual property rights, you may contact the operator at imagetoolskit@gmail.com with a detailed description of the alleged infringement, including sufficient information for the operator to identify the material in question. The operator will review such complaints in good faith and will take appropriate action as warranted by the circumstances.

The Service may contain links to third-party websites, resources, or services that are not owned or controlled by the Image Tools Kit operator. The operator has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. The inclusion of any link does not imply endorsement, recommendation, or approval by the operator.

You acknowledge and agree that the operator shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party website or service. You are encouraged to review the terms of service and privacy policies of any third-party websites or services that you visit or use.

The Service may also rely on third-party technologies, hosting providers, content delivery networks, and analytics services in order to function. The operator selects these third-party providers with care, particularly with respect to privacy practices, but cannot guarantee the performance, security, or policies of these providers. The operator will update these Terms if the use of third-party services materially changes in a way that affects your rights under these Terms.

Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express, implied, or statutory. The Image Tools Kit operator expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranties arising from course of dealing, usage, or trade practice.

The operator does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. The operator does not warrant that the results obtained from the use of the Service will be accurate, reliable, complete, or that they will meet your specific requirements. The operator does not warrant that the output quality, file format, compression ratio, or any other characteristic of the processed file will be consistent across browsers, devices, operating systems, or over time.

You are solely responsible for maintaining and backing up your original files. You should always keep a copy of any original image before uploading it to or processing it through the Service. The operator is not responsible for any loss of, corruption of, or damage to Your Content. You should treat the Service as a convenience tool and not as a sole repository for important files.

The operator makes no representations or warranties regarding the legality, accuracy, or appropriateness of any content processed through the Service. You are solely responsible for ensuring that Your Content and your use of the Service comply with applicable laws.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall the Image Tools Kit operator, its officers, directors, employees, agents, affiliates, or successors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to your use of or inability to use the Service, even if the operator has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the operator’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you have paid to the operator for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100.00). Since the Service is provided free of charge, in practice this amount will be zero dollars.

The limitations in this section apply even if any remedy provided under these Terms fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, the operator’s liability will be limited to the fullest extent permitted by applicable law.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Image Tools Kit operator and its officers, directors, employees, agents, affiliates, and successors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to reasonable legal fees) arising from or relating to:

  • Your use of the Service.
  • Your violation of any term of these Terms.
  • Your violation of any third-party right, including without limitation any copyright, trademark, property, privacy, or other intellectual property or proprietary right.
  • Your violation of any applicable law, rule, or regulation.
  • Any content you upload to, process through, or submit to the Service.

The operator reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with the operator in asserting any available defenses. This indemnification obligation survives these Terms and your use of the Service.

Termination and suspension

Since the Service does not require accounts, there is no formal account termination process. You may stop using the Service at any time. No notice is required from you to discontinue use.

The operator reserves the right to suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, with or without notice and without liability. Grounds for suspension or termination include, but are not limited to, violations of these Terms, behavior that the operator reasonably believes is harmful to other users or to the Service, behavior that exposes the operator to legal liability, abuse of automated access, or excessive resource consumption.

The operator will make reasonable efforts to provide notice before suspending or terminating access, but is not obligated to do so. Urgent situations, including imminent legal violations or active security threats, may require immediate action without prior notice.

Upon suspension or termination of your access, all rights and licenses granted to you under these Terms will cease immediately. The following sections will survive termination: Ownership of your content, Intellectual property, Disclaimer of warranties, Limitation of liability, Indemnification, Governing law and disputes, and Severability and entire agreement.

Changes to terms

The operator reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated “last updated” date. Material changes will be communicated through a prominent notice on the Service’s homepage or through other reasonable means. Your continued use of the Service after changes have been posted constitutes your acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the Service immediately. The operator encourages you to review these Terms periodically to stay informed of any updates. The most current version of these Terms will always be accessible from the Service’s Terms of Service page.

For significant changes that materially alter your rights or obligations, the operator will make reasonable efforts to provide advance notice, such as displaying a banner or notification on the Service for a reasonable period before the changes take effect. However, the operator is not required to obtain your affirmative consent for changes to these Terms.

Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Image Tools Kit operator resides, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the appropriate legal channels in the courts of competent jurisdiction in the operator’s jurisdiction.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against the operator.

Nothing in this section prevents you from filing a complaint with a government consumer protection agency or from exercising any rights that cannot be waived by agreement under applicable law. The operator will comply with all applicable dispute resolution procedures required by the laws of your jurisdiction to the extent they apply.

Severability and entire agreement

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it will be severed from these Terms, and the remaining provisions will continue to bind the parties.

These Terms, together with the operator’s Privacy Policy, constitute the entire agreement between you and the Image Tools Kit operator regarding the use of the Service. These Terms supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to the subject matter of these Terms.

The failure of the operator to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by the operator.
